Terms & Conditions
1. Definitions

“Company” refers to [KM Leaks & Watermains].

“Client” refers to the individual or organisation engaging our services.

“Works” refers to all construction, labour, materials, and services provided.
2. Quotations & Acceptance

All quotations are valid for 30 days from the date issued.

A quotation becomes a binding agreement once accepted in writing or by payment of a deposit.

The Company reserves the right to withdraw or amend a quotation at any time before acceptance.
3. Pricing & Payment Terms
-
A non-refundable deposit (typically 20–50%) is required before work begins.
-
Interim payments may be required for larger projects and will be outlined in the quotation.

Final payment is due immediately upon completion unless otherwise agreed in writing.

Late payments may incur interest at 8% above the Bank of England base rate, in line with the Late Payment of Commercial Debts (Interest) Act 1998.
4. Scope of Work

All works will be carried out as outlined in the agreed quotation or contract.

Any additional work requested by the Client will be treated as a variation and may incur additional costs.
5. Variations & Changes

Any changes to the agreed works must be confirmed in writing.

The Company reserves the right to adjust pricing and timelines accordingly.

Verbal agreements are not binding unless confirmed in writing.
6. Materials

Materials will be supplied as specified in the quotation unless otherwise agreed.

Where specific materials are unavailable, the Company reserves the right to substitute with similar quality alternatives.

Any increase in material costs beyond the Company’s control may be passed on to the Client.
7. Client Responsibilities
The Client agrees to:

Provide clear access to the work site during agreed working hours.

Ensure necessary permissions, planning approvals, or permits are obtained unless otherwise agreed.

Inform the Company of any known hazards or site issues.
8. Delays & Force Majeure

The Company is not liable for delays caused by factors beyond its control, including but not limited to weather conditions, supply shortages, or unforeseen structural issues.

Project timelines are estimates and may be adjusted as necessary.
9. Cancellations

Cancellations must be made in writing.
-
Deposits are non-refundable once work has been scheduled or materials ordered.

The Client may be liable for costs incurred up to the cancellation date.
10. Completion & Snagging

Upon completion, the Client must inspect the work and notify the Company of any defects within 7 days.

The Company will rectify any agreed defects within a reasonable timeframe.
11. Warranty

Normal wear and tear

Damage caused by misuse or lack of maintenance

12. Liability

13. Health & Safety

The Company complies with all relevant UK health and safety regulations.

Clients must not interfere with works or enter unsafe areas.
14. Ownership of Materials

All materials remain the property of the Company until full payment has been received.
15. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through negotiation.

If unresolved, disputes may be referred to mediation before legal action.
16. Governing Law
-
These Terms & Conditions are governed by the laws of England and Wales.
17. Acceptance

By accepting a quotation or engaging our services, the Client agrees to these Terms & Conditions.
